Our office is located in the Prague’s reputable downtown district Bubeneč. If you travel by public transport, take subway line A, get off at Hradčanská or Dejvická station and continue walking no more than 5 minutes to Eliášova street No. 21. If you drive, you can leave your car in the surrounding streets.
Normally, we charge hourly rates agreed with the client. A fixed fee may also be applied, provided that the extent of services is foreseeable and the workload may be reasonably precalculated (e.g. execution of contracts). Preliminary estimations of hourly fees are made in good faith, but do not constitute a fixed fee arrangement. Subject to our sole discretion, contingency fees may be agreed in exceptional cases.
All fees are increased by the applicable VAT rate. Unless agreed otherwise, travel and other costs are not included in the fees rates.
In litigation, an obligation is normally imposed on the losing party to reimburse the costs of the winning party, including its attorney’s fees. However, the reimbursed amount is set as a flat fee or a percentage of the amount in controversy, so it does not necessarily correspond to the fees arrangement made with us – it can be lower or higher. If the reimbursed fees are lower than those agreed, the difference is to be borne by the client.
The client enjoys the advantage of the attorney-client privilege. According to the Czech Act on the Legal Profession, attorney shall keep client’s documents and information confidential and may not share them with any third parties, let alone authorities. The only one who can lift the confidentiality duty is the client himself / herself, or his / her legal successor.
Notarial services are provided by notaries. We cooperate with a notary on regular basis, so we are able to ensure execution of deeds, wills and other notarial acts, or e.g. opening of a notarial escrow. Our point is that our services should be provided as complex as practicable, in order not to burden clients with issues which keep them from their business. Likewise, we ensure assistance of other professionals, such as auditors, tax advisers, appraisers, surveyors or executors.
Bedrna & Partners ensure authentication of signatures in connection with other legal services. E.g. if we prepare a real-estate sales contract, the parties’ signatures are authenticated as a part of the process. Authentication is not offered generally to the public. Attorneys do not have the power to certificate copies, so you should visit a CZECH Point office (e.g. a local authority, notary or post office) with such a requirement.
Bedrna & Partners’ domain is Czech law, but we are able to counsel our clients on certain features of foreign legal systems as well (such as German law). However, clients shall bear in mind that the foreign-law counsel is given for convenience only and expert advice should be solicited from a local attorney. Bedrna & Partners cooperate with law firms in number of jurisdictions (from Slovakia to the United States to China). In case of need, we are ready to intermediate assistance of our partners.
Bedrna & Partners offer escrows of money or documents in connection with sales and other transactions. Opening and operating an attorney escrow is governed by professional rules of the Czech Bar Association and Bedrna & Partners strictly adhere to these rules. In addition, every attorney is insured against damage caused to clients, so the parties are certain to collect the funds in any conceivable case.
The fundamental regulation of the Bar is contained in the Act No. 85/1996 Coll., on the Legal Profession, as amended. A number of additional duties have been adopted by the Czech Bar Association in the form of professional rules (among others the Code of Professional Conduct of Attorneys).
